1. General Provisions

This document is a public offer (hereinafter — the "Offer") of the individual entrepreneur Shpak N.A. (hereinafter — the "Provider") addressed to any person (hereinafter — the "User") who wishes to access the Gym Manager software (hereinafter — the "Platform").

The Platform is a SaaS solution (Software as a Service) — a cloud-based software for fitness activity management. The Provider does not provide personal training, consulting, or medical services.

Registration on the Platform or payment of a subscription constitutes full and unconditional acceptance of this Offer.

2. Subject of the Agreement

The Provider grants the User the right to access the Platform's functional modules according to the selected subscription plan on a non-exclusive license basis.

The Platform includes the following features (depending on the plan):

  • workout planning and tracking
  • exercise programs and workout template management
  • progress analytics
  • nutrition tracking (fatsecret integration)

3. Pricing Plans and Payment

Current pricing plans and prices are available on the pricing page. The Provider reserves the right to change prices with at least 14 days' notice.

Payments are processed via WayForPay (for UAH payments) or Paddle (for international payments). The subscription is activated automatically after a successful payment.

The Platform is a digital service. Access to paid features is granted instantly upon successful online payment — no physical goods are shipped.

A free trial period is provided for the duration specified on the pricing page. After the trial period ends, the subscription does not renew automatically.

International payments are securely processed by our authorized reseller and Merchant of Record, Paddle (Paddle.com Market Limited). By completing an international purchase, you agree to Paddle's Terms of Service.

4. Refund Policy

The User is entitled to a full refund in the following cases:

  • Within 14 calendar days of the first payment, if the User has not actually used the paid Platform features.
  • The Platform was unavailable due to the Provider's fault for more than 72 consecutive hours during the paid month — the User is entitled to a proportional refund.

Refunds will not be issued if:

  • more than 14 days have passed since the payment date
  • the User has actively used the paid features of the Platform
  • the subscription has been cancelled but access continues until the end of the paid period

To initiate a refund, please contact gym.manager.support@gmail.com with your account email and payment date. Processing time — up to 7 business days.

5. Rights and Obligations

The Provider undertakes to:

  • ensure Platform availability of at least 99% per month
  • not transfer personal data to third parties without the User's consent
  • notify about scheduled maintenance in advance

The User undertakes to:

  • not share account access with third parties
  • not use the Platform for unlawful purposes
  • pay for the selected subscription in a timely manner

6. Personal Data Processing

By registering on the Platform, the User consents to the processing of their personal data in accordance with the Privacy Policy.

7. Limitation of Liability

The Platform is provided "as is". The Provider's maximum liability is limited to the amount paid by the User for the last month of subscription.

The Provider is not responsible for the stability, availability, or accuracy of third-party services and APIs integrated into the Platform (including, but not limited to, the fatsecret service).

8. Changes to Terms

The Provider may amend this Offer. A new version takes effect 14 days after publication. Continued use of the Platform constitutes acceptance of the new version.
